Before registering with plugHR (for use of plugHRapp plugHRConsult or runHR or any product/ service, all covered under the name “plugHR” hereon), you must read and agree to this Terms of Service ("TOS"). By using plugHR, you agree to be bound by the TOS and you agree that it is as binding as if it were a written negotiated agreement signed by the business entity lawfully representing plugHR and you.

plugHR has the right to update and change the TOS from time to time without notice, and you agree to be bound by such modifications or revisions. Any new functionality or services that change or enhance the current Service shall be subject to these Terms of Service. If you continue to use the Service after any such changes you agree to such changes and their meaning. The applicable version of the Terms of Service can be viewed here at any time.

Description of Service

plugHR offers a cloud based HR, communication and productivity platform called plugHRapp, a limited period consulting support called plugHRConsult and assistance in evaluating HR professionals for building your internal HR team through the service called runHR. Your use of the Service is at your sole risk. The service is provided on AS IS and AS AVAILABLE basis.

Eligibility

You must be at least sixteen (16) years of age to use this Service. You must provide your current, accurate identification, contact, and other information that may be required as part of the registration process and/or continued use of the Service, including a valid e-mail address. Accounts registered by automated methods are not permitted. Each log-in may only be used by one person. You can warrant other people access to your workspace by inviting them, but they still need to create their own plugHRapp account. Each user is responsible and liable for maintaining the security of their log-in credentials and password. plugHR will not be liable for any loss or damage from failure to comply with this security obligation. plugHR reserves the right to refuse service to anyone at any time without notice for any reason.

Proper Use

You may not use the Service for any illegal or unauthorized purpose. You must not, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws). You are responsible and liable for all content posted to the Service and any activity that occurs under your account. Even when content is posted by - or activities being deployed by - others who have accounts under your account. Verbal, physical, written or other abuse (including threats of abuse or retribution) of any plugHR customer, employee, member, or officer will result in immediate service termination.You are not allowed to modify, adapt or hack the Service or modify another website so as to falsely imply that it is associated with the Service, or any other plugHR service. You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service without the express written permission by plugHR

plugHR can, but has no obligation to, remove content and accounts containing content that we determine in our sole discretion are unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene or otherwise objectionable or violates any party's intellectual property or these Terms of Service.

If your bandwidth usage exceeds 100 MB/month, or significantly exceeds the average bandwidth usage (as determined solely by plugHR) of other plugHR customers, we reserve the right to immediately disable your account or reduce the Service or its availability to you until you can reduce your bandwidth consumption.

Confidentiality

The nature of the Service may result or require us to have access to the materials, information, and content you upload to the service. plugHR acknowledges that some or all of this information may be confidential in nature. By uploading this information to the Service, you agree that plugHR may have such access when necessary and appropriate.

plugHR will undertake reasonable and lawful measures to ensure that the information remains confidential. In particular, unless compelled by law, plugHR shall not directly or indirectly use, disclose, reveal, publish or cause to be disclosed any such confidential information to third parties.

However, please note that confidential information does not include information that at the time of disclosure was generally known to the public; after disclosure becomes generally known to the public through no fault of plugHR; or is already in the possession of the receiving party at the time of disclosure through some other source.

You understand that the technical processing and transmission of the Service, including your content, may be transferred unencrypted and involve transmissions over various networks; and changes to conform and adapt to technical requirements of connecting networks or devices.

Payment Terms

Prices of the Service, including but not limited to monthly subscription fees to the Service, are subject to change without prior notice. Such notice may be provided at any time by posting the changes to the plugHR website or sign up forms but plugHR is under no obligation to do so.

The Service is billed in advance on a monthly, quarterly or annual basis, depending on your region and the pricing policy applicable to that region at the time of your signup and is non-refundable. For any change in team size or any other billing criteria, outside of a trial period if any, you will automatically be charged the new fee on your next billing cycle. No refunds will be made for premature cancellation of subscription. There will be no refunds or credits for partial months of service, or refunds for months unused with an open account.

When payment for an account subscription has not reached the Service in seven (7) days after the initial request, the service will be suspended. plugHR will not be liable for any loss of content, capacity, features or external implications that result from said Suspension.

Each sign-up for a new account will be governed by the pricing plan for your region at the time of signup. There will be no refunds when a user fails, for whatever reason, to cancel the subscription in time and plugHR does not accept any liability for any resulting extra charges.

All payments and payment information for plugHR are handled by licensed commercial entities in different regions or a third-party payment gateway. “plugHR holds no credit card information of any users”

All fees are exclusive of all taxes or duties imposed by governing authorities. You alone are responsible for payment of all such taxes or duties.

Cancellation and Termination

You are solely responsible and liable for fully canceling your subscription. plugHR development, service delivery or support team will never cancel an account on behalf of a user. A support request, forum post, e-mail, telephone call, fax or written request to cancel your account is not considered cancellation. You can cancel your subscription at any time, instructions for which can be found in the plugHR Knowledge Base. Feedback for canceling of an account is displayed in the user interface and before a user sees that notice it must be presumed that an account is not yet canceled. plugHR shall not be liable if a user has failed to follow the instructions precisely.

Your cancellation will take effect immediately or after due exit notice period depending on the type of service you signed up for (details would be shared with you at the ime of signup) and you will not be charged again. However, no refunds will be issued for any previous charges, in whole or in part. In case there was a pre-payment to your plugHR account this credit is not refunded, but you are able to continue to use plugHR until the credit runs out. You will not be charged thereafter. There is no cancellation fee.

Leaving an account does not always automatically cancel payments for the subscription, it is the user's responsibility to check that this has been done.

plugHR shall not be liable to you or to any third party for any modification, price change, suspension or discontinuance of the Service.

plugHR, at its sole discretion, has the right to suspend or terminate any account and refuse any and all current or future use of the Service, for any reason at any time. Such termination of the Service will result in the deactivation or deletion of your account and content or your access to your account and content, and the forfeiture and relinquishment of all content in your account.

Canceling your account and/or running out of credit will suspend your account. In case of a suspended account you have no access to any data, historic or otherwise. Suspended accounts are kept for 12 months and can be re-activated during that time by making a successful payment. If an account remains inactive for 12 months, it will be deleted from the Service and it is not possible to recover any data. You understand and agree to this condition.

plugHR reserves the right to refuse service to anyone for any reason at any time.

plugHR reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice.

Violation of any of the terms in this document called 'Terms of Service' will result in the termination of your account. While plugHR prohibits such conduct and content on the Service, you understand and agree that plugHR cannot be responsible for the content posted on the Service and you nonetheless may be exposed to such materials.

Warranties an Liability

plugHR does not warrant for any of its products or services:

the Service will meet any specific requirements including but not limited to yours;

the Service will be uninterrupted, timely, secure, or error-free;

the results that are obtained from the use of the Service will be accurate or reliable;

the quality of any products, services, information, or other material purchased or obtained by you through the Service will meet your expectations;

any errors in the Service will be corrected.

You expressly understand and agree that plugHR shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if plugHR has been advised of the possibility of such damages), resulting from:

the use or the inability to use the service;

the cost of procurement of substitute goods and services resulting from any goods, data, information or services purchased or obtained or messages received or transactions entered into through or from the service;

unauthorized access to or alteration of your transmissions or data;

statements or conduct of any third party on the service;

or any other matter relating to the service.

The failure of plugHR to exercise or enforce any right or provision of the Terms of Service shall not constitute a waiver of such right or provision or any other right or provision or term described in the terms of Service. The Terms of Service constitutes the entire agreement between you and plugHR and governs your use of the Service, superseding any prior agreements between you and plugHR (including, but not limited to, any prior versions of the Terms of Service).

Personal data

When you visit plugHR website www.plugHR.com , we ask you for your name, email, contact number and purpose of your visit. This information is meant for our business team to be able to connect back with you and help you find suitable solutions from our product portfolio. The information you provide is shared with internal staff on need to know basis. You do not contract any service just by providing this information on our website. When you sign up for an account in plugHRapp we ask for your e-mail address and a password which will become your login credentials to sign in to plugHRapp. You become a contracted user of plugHRapp only when you get a unique company id and user id that you would use to login into your own account in plugHRapp. Your display name is only used within your Organisation’s plugHRapp account, and on any printouts. Your display name is not provided to any user in accounts other than your Organisation’s or other third parties.

Most information collected within plugHRapp is not for the purpose of your usage within your Organisation’s acount and none of it will be used outside your Organisation’s account or passed on to other third parties.

We collect and store IP-address for each user for statistical purposes. Your IP-address will not be disclosed to any other third party.

Cookies

plugHRapp uses a technology called "cookies" to store session information. This is a small file on your computer hard drive which will be created and accessed by your browser and contains an anonymous unique identifier.

We currently use persistent cookies in plugHRapp to store the login session ("Remember me"). A persistent cookie remains on your hard drive for an extended period of time. You can remove persistent cookies by following directions provided in your Internet browser’s “help” file.

Payments

Payments are handled by commercial entities holding rights to monetise plugHRapp, may be different entities in different countries. You will be redirected to the sign up page over secure link and you will enter all information necessary for payments there in secure manner. Once your payment is received, you plugHRapp account will get activated then. plugHRapp will store your billing address for receipt display purposes.

Ad servers

We do not partner with or have special relationships with any ad server companies. We do not provide any user data to any ad server companies.

Newsletters and other e-mail deliveries

As part of the service plugHR and plugHRapp is sending out a periodic newsletter. Your name and e-mail address are used for sending the newsletter. You can opt out of receiving a newsletter by clicking a link within the newsletter itself.

plugHRapp will send a welcoming email to verify your new account. We also send out invitation e-mails to people you have invited to join your account. You can always request a password recovery email from plugHRapp.

We might email account administrators for billing related purposes.

We will occasionally send out announcements related to plugHR and plugHRapp service in general.

Blog

If you use the plugHR blog, you should be aware that any personally identifiable information you submit there can be read, collected, or used by other users of these blogs. plugHR is not responsible for the personally identifiable information you choose to submit in these blogs.

Support forum

If you post to the plugHR Public Forums, you should be aware that any personally identifiable information you submit there can be read, collected, or used by other forum visitors, and could be used to send you unsolicited messages. plugHR is not responsible for the personally identifiable information you choose to submit in these blogs.

Support requests sent by you through plugHR feedback or support email will remain private. Some information (e.g. new features) in those requests can be published with your consent.

Data Security

plugHRapp operates over Secure Sockets Layer protocol (HTTPS), so that the information exchange between you and plugHRapp is encrypted. plugHRapp only uses a valid SSL certificate from major service providers.

We have appropriate security measures in place in our physical facilities to protect against the loss, misuse or alteration of information that we have collected from you at our site.

Changes in Privacy Policy

From time to time, we may use customer information for new, unanticipated uses not previously disclosed in our privacy notice. If our information practices change at some time in the future we will post the policy changes to our Web site to notify you of these changes and we will use for these new purposes only data collected from the time of the policy change forward. If you are concerned about how your information is used, you should check back at our Web site periodically.
